搜索引擎服务商对第三方网站中的文件提供链接属于侵权法上的“帮助”行为，对此行为进行归责应适用过错责任原则，认定其是否构成“帮助侵权”的关键是判断是否存在主观过错。此时，作为搜索引擎服务商免责机制的“避风港原则”，便成为认定其是否存在主观过错的有效且简单易行的规则，而对适用此原则的例外情况，“红旗标准”则能在认定上起到有效的补充作用。我国立法上应当对“红旗标准”的精神加以吸收，以完善搜索引擎“帮助侵权”的认定规则，更好地解决相关的法律纠纷。
